Restricted Practice

CRNA: state has NOT opted out of the CMS Medicare physician-supervision requirement; physician supervision is required for CRNA anesthesia services under Medicare. State scope may differ.

Prescriptive Authority: NY Education Law Art. 139 (§6902) grants prescriptive authority only to nurse practitioners (§6910); it contains no CRNA scope-of-practice or prescribing provision, so CRNAs have no independent ordering authority (anesthesia plan ordered/directed by operating physician per 10 NYCRR §405.13). Proposed Art. 139-A (S357/A6771) not enacted.
